Ethical Decision Making Essay
Abstract What is ethics and what place does it have in decision-making? Ethics means different things to each of us. We develop our ethics from our culture, ethnic background, religious beliefs and all that make us unique as humans. Knowing this does not help when we are asked as administrators or managers to make decisions that are jam-packed with ethical dilemmas. Acting as Faith Community Hospital (FCH) administrator I turned to the Santa Clara University website, article ââ¬Å"A Framework for Ethical Decision Makingâ⬠. This article gives five steps that I will use to address the problems FCH face. They are: Recognize a moral issue, Get the facts, Evaluate the alternative actions from various moral perspectives, Make a decision, Act, then reflect on the decision later. Ethical Decision Making Trying to determine the meaning of ethics is, to say the least, a challenge. My search for that meaning took me to the Santa Clara University website. There I found discussions that I agreed with. Sociologist Raymond Baumhart found that replies to the question ââ¬Å"What does ethics mean to you?â⬠was as diverse as those he asked. The answers varied from personal feelings to what is socially acceptable, from religion to legality. So then, what does it mean to be ethical in your decision-making? Shanks tell us ââ¬Å"because we have the ability to be critical of our interpersonal behavior . . . . . we have the ability to develop codes and norms to guide that behavior. Those moral norms and codes, plus a set of virtuous character traits, are what we mean when we talk about ethics.â⬠He also tells us that while we all endeavor to make ethical decisions we run into ââ¬Å"stumblingà blocksâ⬠inhibiting our ethical decision-making. He lists the following: -ââ¬Å"My small effort wonââ¬â¢t really make a difference -People may think badly of me -Itââ¬â¢s hard to know the right thing to do -My pride gets in the way -It may hurt my career -It just went by too quickly -Thereââ¬â¢s a cost to doing the right thingâ⬠Weââ¬â¢ve all had to face these ââ¬Å"stumbling blocksâ⬠. This is why ethical decision-making is so personal and varied. In our case study of Faith Community Hospital we came across many issues needing resolution. The majority if not all of them required ethical decision-making. Faith Community had a diverse group of employees, and each of them had their own set of ethical/moral standards. While administration can appreciate those differences, the responsibility to bring unity to the organization falls to them. Putting my self in the role of administrator, how do I accomplish this task? Again, I turn to the Santa Clara University website, to the article ââ¬Å"A Framework for Ethical Decision Makingâ⬠. This article gives five steps that I will use, they are: 1.Recognize a moral issue 2.Get the facts 3.Evaluate the alternative actions from various moral perspectives 4.Make a decision 5.Act, the reflect on the decision later First, recognize a moral issue. At Faith Community there are several issues. They are: -Staff on both ends of the spectrum of Do Not Resuscitate (DNR) orders. I have staff that resuscitate when a DNR is in place as well as staff that do not resuscitate when a DNR is not in place. -Staff refusing treatment to patients without first confirming insurance coverage as well as requiring HIV clearances. -Unauthorized pro bono treatment and installment payments on prescriptions. -Unnecessary treatments being performed Second, get the facts. To some extent the facts speak for themselves. Staff is acting on their individual code of ethics without regard or possibly without knowledge of the hospitalââ¬â¢s code. With respect to the DNR issues, in all cases the family members were happy, but in this case, as administrator their happiness is not the issue. The legality however is. DNR orders are for the protection of the hospital and its staff. If they are not adhered to that protection is none existent. What are the facts surrounding treatment or lack thereof? Investigation again reveals varied results. I have staff that fear for their personal safety, so they require HIV clearance before treatment. I have staff that is concerned for the welfare of the hospital, so they require insurance verification prior to treating. I have staff that care for the patients themselves so much they provide free service or payment on installments, both occurring without consent of administration. I also have staff the order treatment just for the sake of doing the procedure. Third, evaluate the alternative actions from various moral perspectives. While the hospital mission ââ¬Å"to promote the health and well-being of the people in the communities we serveâ⬠must remain a focal point, as administrator the overall health of the organization falls to me. The decision on what treatment should be given should be at the discretion of the physician. The physician must not abuse this authority by ordering those treatments that are not necessary for the welfare of the patient. Even though I can appreciate and even respect the values presented by the staff the truth of the situation is that not everyone is going to be happy. What is going to ââ¬Å"promote the common goodâ⬠for all concerned? This becomes the question to answer. Fourth, make a decision. The number decision is the development of policies and procedures that address the identified issues. With regard to: -DNR orders: Once the policy is written concerning implementation of DNR orders, staff in positions to implement these orders will receive written copies of the policy at a mandatory training session. Each staff member will also be required to sign and acknowledgement form indicating receipt of the policy and personal accountability should policy not be adhered to. -Refusal to treat. In addition to the newly developed policies and procedures a new department will be created. The sole function of this department is to determine insurance eligibility. If the patient does not have insurance, it will be determined if they are eligible for state or federal aide. If it is determined they are rejected in both arenas and their injuries are not life threatening, they will not be treated. Training will be held to address both insurance issues and personal safety issues. -Treatment in general. All staff will be required to sign an acknowledgement as to hospital policy regarding non-emergency treatments. This policy will address: unnecessary procedures, when and if pro bono services will be allowed, as well as acceptable financial agreements with the hospital. Fifth, act, and then reflect on the decision later. Consistent reevaluationà of all new policies will be essential. Through their monitoring, I will be able to identify problem areas as they arise and fine-tune the process to deal with them. The decision making process is constant. In order to maintain the health of an organization the process must remain fluid. This is mandated by the one constant in every workplace. THINGS CHANGE! Conclusion Utilizing the five steps outlined in the Santa Clara University website, article ââ¬Å"A Framework for Ethical Decision Makingâ⬠, allowed Faith Community Hospital to benefit from a good ethical decision. While all concerned my not is happy with the outcome, the guesswork has been eliminated providing for more consistent and I believe better treatment for the community being served by FCH. Interpersonal Process: Decision Making in Organizations Essay
The crucial part of any organization is making good decisions in the various contexts. To reach good decisions, they need reliable information, experience in interpreting information, and reaching a consensus. However, this process of decision-making remains incomplete without the consultation process as the view and expertise of other people in an organization can help to admit one or alter oneââ¬â¢s mind. The process of decision-making is supported by various tools and techniques that help an organization better sort and analyze the information by adding numerical and objective precision to minimize the level of subjectivity. As organizational decision-making process is people-centric and it always has some level of subjectivity in it, some sort of training can enable managers to be better decision makers. A supportive environment where one is fairly criticized for making wrong choices and proper support from other group members and superiors enables managers to make better decisions (Kippenberger, T, 1998). The importance of interpersonal process of decision-making is obvious in all types of decisions made in the organizational context such as strategic decision of investment and direction of future growth taken by the board of director and tactical decision about material handling and effectiveness at departmental levels taken by managers. In addition, in the 21st century of market-oriented and customer focused approach also puts pressure on employees to make decision about their own tasks, responses to customers and improvement to business practice. The process of first collecting alternative possibilities and then converging on a solution is referred as decision making. In fact when we decide we try to cut off from all other alternatives as the Latin root of the world decision suggests and means. In the presence and emergence of new innovative solutions and huge variations in the ways business are being done, decision making process still remains a human process. However, the advance methodologies and MIS have reduced the level of human efforts in collectingà and sorting the information thus making the decision-making process comparatively less complicated and difficult. As we have already explained that decision-making is a human-centric process, the importance of interpersonal skills of influencing others, conflict resolving, communicating, and conveying the messages etc cannot be minimized. Decision-making is not only confined to only choosing among the alternative solutions and diverging but this process also involves dialogs, brainstorming, contemplative reflection, critique and conflict resolution. In addition, interpersonal processes of decision making is much evident in new types of organizational structures such as team-based matrix structure where collaborative and group decision-making are increasingly being used to enhance decision-making process as compared to the conventional decision-making processes. GLOBALIZATION: The fast spread of phenomenon of globalization is increasing the present level of complexity o the ways of decision-making as to collect and process the data becomes a difficult and cumbersome issue. As boundaries of the countries are getting wider and non-evident in the presence of globalization, organizations are under huge pressures to make decisions collaboratively to effectively manage the flow of goods, services, labor and capital. These organizations to win the increasingly competitive environment have started to rely on participatory and inclusive approaches to decision-making and knowledge creation. As global organizations have their offices spread across many countries of the world make use, they have to arrange meeting online, face-to-face discussions and group participations from distant and geographically disparate locations. This process of decision making utilizes certain online technologies and solutions to increase the level of efficiency, however, these tools only support the human-centric decision-making process and donââ¬â¢t become alternative to interpersonal process of decision-making. In addition, these tools enhance and improveà communication, learning, creativity and problem solving abilities of management (Anonymous, 2007). GROUP DECISION MAKING: Over the past few years group decision making has become much common and popular as its important function is to come up with a collective decision through discussions, and diversity of ideas, and thus making this process more interpersonal. Sometimes individual membersââ¬â¢ enduring attitudes is shifted to the more polarized group position. One of the benefits of this interpersonal process of decision-making is the group membersââ¬â¢ learning from each other and mutual persuasion. However, the view point of one member has strong influence on the behavior and attitude of other members even if they sometimes donââ¬â¢t give due importance to each otherââ¬â¢s arguments (Isenberg, 1986). Seeking the arguments of most participants but also resolving and mitigating the minority objections is another from of group decision making referred as Consensus decision-making. It is more participative, collaborative and interpersonal approach of decision making. For instance, many organizations use Robertââ¬â¢s Rule of Order for structuring debate and passage of proposals to reach to a majority decision, however, the goal of full agreement and consensus is often missed. As this process often formulate adversarial debates and competing factions, disturbing group membersââ¬â¢ relationships, it become much difficult for a group to cooperatively and collaboratively implement a contentious decision (Jeffery, A. For example, gurgling sounds issuing from the closetââ¬â¢s drainpipe and the monster springing out of it, in the novel ââ¬ËItââ¬â¢ is an excellent example of how king can employ settings to create horror. Similarly, writers present old houses, damp cellars, dungeons, forests and abandoned castles in horror fiction to evoke a sense of the primordial fear in the readers. Fictional horrors have a great effect on the minds of people because often readers are tempted to believe that the incidents portrayed can actually happen in their lives. Generally, the main theme of the horror literature is the struggle between good and evil forces which is true in the case of King also. However, a unique attribute of Kingââ¬â¢s writings is his skill, in explaining things rationally with the help of horror. A good number of horror novels deal with the thirst for knowledge and how it affects our society. Most of such novels fall into the category of science fiction.

The charismatic leader can see a clear vision and stimulates the follower to follow it and become just as elevated as the leader. Negative aspects of the charismatic leader may include streaks of narcissism, self-aggrandizement, and a forced or contrived distance from followers, all in the efforts of maintaining hero status. Miller contrasts the charismatic leader with the transformational, or transforming leader as expounded by Burns, but importantly expanded with Boulding's theory of love. Burns theory defines the transformational leader as one who basically seeks to convert followers into leaders and into moral agents. Bouldingââ¬â¢s identifies love as a type of power. There is no power outside of human valuation. Power integrates human valuation within organizations, and 'the most fundamental form of integrative power is the power of love' (p, 184) There is no c ompetitive, opposing, or abusive force in Boulding's concept of power. Merged into Burnââ¬â¢s view, love becomes the integrator and the enabling force allowing the transforming leader to empower the follower by letting them have and pursue their own vision, and to enable a dimension of mutual interaction where both leader and follower are being transformed. The leader is able to see that the followersââ¬â¢ visions can align with that of the organization in a cooperative and sharing way. Leaders in this way learn from followers just as followers learn from leaders. Whereas the charismatic leader must seek agreement and commitment from followers as to a certain vision he or she is credited with having, the transforming leader offers a context for sharing and participation in the process of vision making. Weinerââ¬â¢s shapes a picture of the transformational leader as one who is more combative and confrontational. Importantly it is based on the theories of educator Paulo Freir e. Freire pursued his theories from a personal knowledge of poverty and hunger and essentially sought to make structural changes in the way education was being delivered to the poor. Weiner portrays the leader as doing ââ¬Å"oppositional workâ⬠but working within the cultural hegemony as theorized by Antonio Gramsci. Gramsi refined Marxism to recognize that there was a civil society that was accepted by most people. This society had values and beliefs that formed a hegemony. Gramsi believed that this cultural hegemony could be changed from the inside, gradually, without a violent overthrow. This was basically Friereââ¬â¢s belief, that he could educate the poor and that they themselves could bring structural change upon society. Weiner writes as if teachers are continuously battling neoliberal and right wing ideology. But he accepts Freireââ¬â¢s message as one of social justice and democracy. Freire dedicated his life to serving the poor. Through his example Weiner is abl e to define the transformational leader as an activist one who is dedicated to change but who, importantly, works within the ââ¬Å"dominant structures of power and authorityâ⬠to serve the poor (p. 91). Today we can ask ourselves what kinds of leaders are appropriate in a world that has just experienced a great economic recession and the wants and needs of the poor and have-nots have become more sharp and bare? Discussion of the Play Behind the Beautiful Forevers The play Behind the Beautiful Forevers is based on the book of the same title written by Katherine Boo. It was adapted into a play by David Hare. It focuses on the lives of two matriarchal families living in a slum- Annawadi, which is just next to the Mumbai airport. The slum is surrounded by luxury hotels on all sides, while it is full of trash that has kept on pilling and accumulating over the years. These families in the play largely represent the majority of the families in Mumbai. Families that have been let down by the systems that were put in place to be of assistance to them, the hatred of the poor towards one another and the resilience with which this families withstand all these and stick together throughout the difficulties (Hare 2). The Husainââ¬â¢s story shows how difficult it is to do good in an imperfect world where all systems are corrupt and the individuals are evil. One then wonders how the people at the bottom of the heap of trash can be honest in a world full o f bribes and corruption. The system should be where people run to when they have problems but that does not seem to be the case, the affluent are getting it all; the privileges given by the system because they are able to pay for the services offered, while the police donââ¬â¢t care about the poor people in the slums at all because most of them cannot afford to pay the bribe. Behind the Beautiful Forevers depicted Mumbai as a city of contrasts, where immense wealth and extreme poverty are rarely distant. It also shows how corruption in the public institutions and systems tends to undermine the communityââ¬â¢s quality of life. The play reveals the obstacles to fairness and societal mobility in India. It also shows how young people in Annawadi remain hopeful through their personal philosophies especially in this time of global change. Abdul is the representation of a generation of young Indians struggling to elevate themselves out of poverty. The setting onstage truly depicted the lives of the characters, there was a motorcycle on stage and a tuk-tuk too which was a typical Indian medium of transport and it was even driven on stage. There was use of a strong noise of a plane landing, which brought out the closeness of the slum to the airport. The loud roar of the plane drowns the screams of Kalu as heââ¬â¢s being attacked and later murdered by two drug dealers, who thought that he had given the police information about them. This was a very dramatic scene with the noise at its loudest and the screams from Kalu together with the roaring of the plane set the tone of the play right from the start. As the play began, the shadow of a mighty passenger jet flew low over the Olivier stalls, the closeness of its very loud roar made the scalp tighten. Then, like a deluge of blessings, a cascade of used plastic bottles dropped from the skies. A pack of scavengers with their cardboard scoops went into a frenzied overdrive. This clearly depicts the huge gap between the affluent and the poor in Mumbai. The rich fly above the poor and leave them scrambling for their left over without a care of what is going on below them. David Hare while writing the play did not identify a single main character to pivot and plot the play around. This I believe was a calculated risk he decided to take as the play has various characters that we have to get a hold of and there are also many stories to tell, the play thus keeps rotating on each one of the characterââ¬â¢s lives and the struggles they go through as individuals and also as a family unit, especially when the one legged Fatima due to her jealousy of the Husainââ¬â¢s relative prosperity, inflicts burn wound on herself and later accuses them of being responsible for her injuries. As with most stories that have a strong sense of place the play opened up to universal understanding. The play created tension between the perception of the situation and the energy of the place; this is because the sense of darkness was not because of the awful things that were happening to Husainââ¬â¢s family through the play or the poverty in Annawadi. The Husain family actually at this difficult time, depicted resilience in the face of the problems that later followed, after the one legged woman blamed their family for her injuries. Their integrity came under scrutiny the family fortune was wiped out by the grasping ââ¬Å"justiceâ⬠system as they struggle to clear their name and we see a corrupt system where one has to pay a lot of money to see their own charge sheet. We have a glimpse of the corrupt nature of the legal system and the essential injustices of a society in which the poor repeatedly blame equally poor individuals for their misfortunes. The Husain family however shows an extraordinary story of hope, despair and the unity in and strong ties in the family unit. The writer David Hare portrays the compromises the individuals in the play have to make in order to survive and have and get to the top of the heap with flashes of compassion and understanding, so that the audience actually relates to the cast. For instance: Asha having to sleep around in order for her daughter to get an education. The Husains having to pay the officer at the station just to see their charge sheet and due to the bribes they keep giving they lose all they worked so hard to build. They are back at the bottom where they started. The darkness is because of the one thing that both the poor have learned, though in different ways and contexts but nevertheless the same thing, that the road to happiness and success involves mistreating and trampling over other people. It is this dark thought that pollutes the mind and pollinates the minor and small sins done by individuals and leads them to escalate and the tragedy multiplies. The adults have been depicted as having learned the wrong lesson; this left the children as the sensible untainted individuals in Annawadi. The young people in the play representing the youth in India, were shown as being the future of the country. The future where there will be no corruption as they could not stand for it or condone it. As is today the young people do not believe in corruption, they stand against the vice and even hold demonstrations in the streets to protests against it. The young people can now hold the public institutions accountable for any misappropriation or abuse of office. Public offices still subtly favor a certain section of members in the society, because of their contribution to one or two of the organizationââ¬â¢s projects, it however is not as rampant and if one is found out they could definitely be prosecuted. Thus the young people in the play represent the views of the young people in the world right now. This character in the young people was however often regarded to as an act of revolt throughout the play we saw, Abdul round up on an officer who was asking for money in order to abort his fatherââ¬â¢s trial, Manju who has hopes of being the first woman in Annawadi to gain a degree also rejects the means through which her mother employs to pay for her education. Meena, Sunil and Kehkashan are also not left behind as they are also shown as being perceptive with an unbending, understanding of something they couldnââ¬â¢t get themselves to voice. Abdul brings together an energy that was out of control in the slum area and gets rid of the darkness engulfing them. This might well have been the start of something or nothing really but at least it was the moment the play was more than a vicious cycle that one was unable to escape from. In as much as David Hare has done his best to get the most important themes from the book and release the play as the book is, there are a few things that we still miss from the book. For instance the play does not show Ashaââ¬â¢s involvement in the local politics which was always the driving force behind her ambitiousness; to get to the money and power that runs the Annawadi. The play however managed to bring the described image of the Mumbai slum close to the audience and he did this in a major way through the set up on stage and by focusing on the continuous and endless toil of the characters and the recreation of grim physical context in detail. From the play we also gained the sense of getting to see a living community and the young people in resistance of the corruption that was being accepted by the adults. In the United States today there are millions of corporations in many different industries. All of them must abide by the current taxation rules and regulations that have been set by IRS and congress. The Internal Revenue Code, which was originally founded in 1939, set the foundation for the codification that we have in place today. The code arranged all Federal Tax provisions in a logical order and placed them in a separate part of the federal status. Over the years, congress has updated and amended the tax code in 1954, in 1986 Tax Reform Act, and is constantly updating the code due to its importance in assessing judicial and administrative decisions. The arrangement of the code is broken down starting with a Subtitle, broken down into chapter, subchapter, part, and then section (2). It is extremely important for Corporations today to make sure they understand the tax code so they can be aware of the benefits and consequences that may arise in daily business transactions. Asset and property transactions are a large of certain corporations day-to-day operations. Normally property and asset transactions will produce tax consequences if a gain or loss is realized. A transfer of property to a corporation in exchange for equity creates the grounds for a taxable sale and the amount to be recognized but there are exceptions to the rule (4). The code does provide exceptions to the rule and allows ways around recognizing a gain or loss upon the transfer of property to a corporation. Section 351(a) is one exception to the rule. The general rule states, ââ¬Å"No gain or loss shall be recognized if property is transferred to a corporation by one or more persons solely in exchange for stock in such corporation and immediately after the exchange such person or persons are in control (as defined in section 368(c)) of the corporationâ⬠, according the internal revenue code (1). The idea and principal behind the rule is based on the transfer of property and isnââ¬â¢t a closed transaction because a transferor has not cashed in the position in the transferred property. Instead, the person continues to own the transferred property throughout ownership of the transferee corporation stock and there has just been a change in the form of ownership. Congress believes that tax rules should not hinder firms from making business decisions, hence why section 351 was written (10). In order for section 351 to be used and applied there are 3 items that must be met for the transaction to be considered for the non- recognition treatment. The first requirement is that there must be a transfer of ââ¬Å"propertyâ⬠to a corporation. It is very important that corporations understand the definition of property because in the past issues have arose. Plant, Property, Equipment, installment obligations, and unrealized receivables of cash basis are all considered as property. The main property exclusion in the code is that services are not considered as property (6)(11). Another requirement is that the transferors must receive common or preferred stock that is not qualified preferred stock of the transferee corporation. Non-qualified preferred stock is not permitted because it has similarities to debt instruments. Stock warrants and stock rights are also excluded and would be treated as boot (7)(11). The third requirement that must be met in order for a corporation to use section 351 is that once the transfer is complete, the transferors must be in control of the transferee corporation within the meaning of section 368(c). Control means that the people involved must own a minimum of 80 percent of the total combined voting power and numbers of shares of stock. The two criteria for control both must be satisfied as per Rev. Ruling 59-259. Section 351 is a mandatory transaction if a transaction meets the provisions requirements as per Gus Russell, Inc. v. Commissioner, 36 T.C. 965 (1961)(8). If and when all of the section 351(a) requirements are met, the transferor will not recognize a gain or loss on the transfer property to the corporation. During the transaction, if the transferor receives boot, section 351(b) requires them to recognize the gain (capital, long-term, or short-term) equal to the lessor of the gain that would be recognized under section 1001 if the transferor were treated as selling property transferred and the fair market value of the boot received. Under section 351(b)(2), no such loss of any realized loss to be recognized (4)(8). There are situations where once the 351(a) factors are met, a transferor will transfer stock received to someone outside of the control group, and then the requirement after might not be met. A transferor might distribute some of the control received to the shareholders after the requirement based on 351(c). This type of distribution can be taxable to both the shareholders and the distributing corporation. Section 351(c) also relates to situations where there has been a transfer of stock to a corporation in a section 355 transactions (7). Section 351(c)(2) allows shareholders to dispose of all or part of the transfers stock without preventing the corporations Section 351 transaction from satisfying the ââ¬Å" control immediate afterâ⬠requirement (4). Section 351(d) states that there are times when services, certain indebtedness, and accrued interest not treated as property as per James v. Commissioner, 53 T.C. 63 (1969); cf. Hospital Corporation of America v. Commissioner, 81 T.C. 520 (1983). An example of this would be receiving stock for legal services (11). Even though there are major benefits to meeting the requirements of section 351, one of them being the ability to permit shareholders of a corporation to defer recognition of a gain or loss on the transfer of assets to the corporation, there are also times that it will be advantageous for a corporation to avoid using Section 351 for tax planning purposes (9). A transferor might want to be able to recognize the gain if it will not negatively affect them. If a transferor is in a low tax bracket or the gain could be a beneficial capital gain that could be offset with capital losses, they might not want to use section 351. Another scenario where it could be an advantage not to use section 351 would be if the transferor wanted to allow for immediate loss recognition. There are alternatives for a transferor who would like to recognize the loss (3). Back in March of 2005, the IRS and treasury department proposed a ââ¬Å"net valueâ⬠regulation to address the application of several non-recognition provisions to the code. The idea behind the proposal was to add the concept of ââ¬Å"exchange of net valueâ⬠requirement to Sections 332, 351, and 368(6). The reason being that a ââ¬Å"net valueâ⬠is appropriate because a transfer of property in exchange for the assumption of liabilities resembles a sale and should not be afforded. For the purposes of section 351, stock would not be treated as issued property unless the fair market value of the assets of the transferor corporation exceeds the amount of its liability immediately after the transfer (5). In conclusion, corporations need to make sure that they understand the tax codes and regulations that are set in place by the internal revenue code. Section 351 is a very interesting section and should be used in tax planning with corporations that are involved with property and asset transactions will that will produce tax consequences if a gain or loss is realized (2). In order for a corporation to use the section, all three preliminary requirements must be met. Just like any code section there are advantages and disadvantages of meeting the requirements and applying the code section to a corporation.
